Payment

• Cash, payable upon pick up of plant material.
• Orders to be shipped must be paid in full one week prior to shipping date.

For customers who have established credit and who have a record of prompt payment, our terms are:

• Net payable within thirty (30) days from invoice date.

A service charge of 2% per month (24% per year) will be assessed to all accounts passed 30 days.

Conditions

The Buyer and Seller hereto agree that this contract is made in Ohio and shall be governed under Ohio Law. Venue for any action pertaining to a sale made under this shall be Lorain County, Ohio.

Ohio law requires that sales tax be charged on all tangible personal property, including plant material. Sales tax will be charged on all invoices unless a valid certificate of exemption has been submitted.

Warranty

Our plants are warranted to be true to type, to comply with or exceed the standards of the American Standard for Nursery Stock, and to have been inspected and certified by the Ohio Department of Agriculture. No other warranties are expressed or implied. All claims must be made in writing within ten (10) days of receipt of plant material. In no case shall our liability exceed the original purchase price of the plant material.

Prices and Quotes

All orders are F.O.B. The Poruban Nursery. Prices are subject to change without notice. Written quotes are available upon request, and the quoted prices are valid for thirty (30) days from the date of the quote unless the order is secured by P.O. number or a 25% down payment.
